Summary/Abstract: The aim of this paper is to clarify the genesis of the enforcement of the most favourable criminal law after the final trial of the case. The objectives of this research refer to the introduction of the regulations and the practices in the field of the enforcement of the more favourable criminal law, the elaboration of a comparative analysis concerning the regulations and the judicial practices specific to the research theme within the Courts of Law and of the impact of the approach such a subject could have in our country and in the European space.
