Effects of judicial gender change in relation to parenthood based on the decision of the Court of Appeals in Wrocław of 7th March 2016 (I Aca 1830/15)

Summary/Abstract: In this article the attempt to analyse the legal situation of transgender people in Polish civil law, especially in the context of parenthood, was analysed. Taking into account the permanent development of medicine, the possibility of changing the biological sex of a human being, and the difficulties associated with the broad spectrum of the effect of such action, both in relation to the person making the decision and those close to him, this issue mentioned in the title requires thorough legal analysis. The purpose of this article is to indicate possible ways to interpret the decision of the Court of Appeal in Wrocław of 7th March 2016 (I ACa 1830/15) and attempt to find a solution that respects the autonomy of a transsexual person as well as being supported by applicable law.
