Summary/Abstract: The revision of the Constitution, in 2003, through the harmonization of its text with the legislation of the EU members has created compatibility between the Romanian fundamental values and the similar European institutions. Efforts towards the integration of the national army in the Euro-Atlantic structures have determined an alignment of military and juridical institutions with the Occidental standards. In the process of adherence to the Euro-Atlantic security institutions, reorganization and technology improvement were necessary; also an adaptation of the national legislative frame was necessary in order to achieve the needed flexibility for making a decision regarding the participation of forces and resources in missions outside the national territory. Article 118, from Romania’s Constitution, stipulates: “the army contributes to the collective defense in the systems of military alliances and participates to actions concerning peace maintenance or restoration”, also stating that “in Romania’s territory foreign troops can enter, stay, develop operations or pass only in the conditions of the law or the international treaties to which Romania belongs”.
