Summary/Abstract: In as far as the application in time of the penal law, the New Penal Code brings about a series of supplements to the measures regarding the more favourable penal law to be applied in a criminal trial.For a better understanding of the new penal dispositions concerning the application of a more favourable penal law, all through the present paper I have described the conditions in which the more favourable penal law should be applied, the criteria according to which this more favourable law shall be settled, the significance of the lex tertia and the application of the mitior lex in conformity with all juridical institutions.
