Brief Considerations Regarding the Abuse of Dominant Position

Summary/Abstract: The role of competition in a functioning market economy is to ensure gaining profit, deservedly, of the best player of the market. However, it is a fact that the undertakings who have a dominant position are using their power to earn on certain market segments, pursuing objectives that are not related to the product quality or to the good business practices of trade. The maintaining or the strengthening of the market position of such undertakings by resorting to abusive business behaviors damages to consumers’ interests and it represents distortions of the competitive process, sanctioned by European Union law. This article is focused on this issue covered by relevant European regulations in the field of competition.
