An unacceptable "self-denunciations" or a legal information obligation? Remarks in the margin of judgments of the Constitutional Tribunal of March 12, 2014 (P 27/13) and September 30, 2015 (K 3/13)

Summary/Abstract: Artykuł stanowi krytyczną analizę instytucji unormowanej w art. 96 § 3 Kodeksu wykroczeń w świetle dwóch orzeczeń Trybunału Konstytucyjnego, dotyczących fundamentalnych wątpliwości w zakresie dopuszczalności ingerencji państwa w życie prywatne obywateli oraz granic prawa do obrony przysługującego osobie, której odpowiedzialność karna jest lub potencjalnie może być ustalana. Autorka krytycznie ocenia umieszczenie obowiązku nałożonego na właścicieli (posiadaczy) pojazdów mechanicznych w obszarze prawa karnego sensu largo oraz polemizuje ze stanowiskiem Trybunału Konstytucyjnego w kwestii przysługującego sprawcy prawa do obrony. The article is a critical analysis of the institution regulated in art. 96 § 3 of the Code of offenses in the light of two rulings of the Constitutional Tribunal regarding fundamental doubts as to the admissibility of state interference in the private life of citizens and the limits of the right of defense of a person whose criminal liability is or may be determined. The author criticizes the placement of the obligation imposed on owners (owners) of motor vehicles in the area of penal law in the strict sense and argues with the position of the Constitutional Tribunal regarding the rights of defense of the perpetrator.
