Commentary to the Supreme Court decision of 31 March 2015, I KZP 1/15

Summary/Abstract: W glosie podjęto polemikę z postanowieniem Sądu Najwyższego, będącym kontynuacją rozbudowanej linii orzeczniczej uznającej dobro rodziny za główny przedmiot ochrony przestępstwa z art. 207 § 1 k.k. Problem właściwego określenia dobra chronionego przez art. 207 k.k. ma fundamentalne znaczenie dla szeregu kwestii poruszonych w analizowanym postanowieniu. Autorki wskazują dobra prawne wynikające z art. 207 k.k., biorąc pod uwagę aktualne orzecznictwo, a w szczególności przedmiot ochrony, do którego odwołuje się w swoim postanowieniu Sąd Najwyższy. Pochylono się nad kwestią, czy pojęcia „rodziny” oraz „osób najbliższych” są tożsame. Ponadto w glosie poruszone zostały zagadnienia dotyczące roli, jaką pełni tytuł rozdziału Kodeksu karnego dla wyznaczenia chronionego przez dany przepis dobra prawnego. In the commentary a polemic was taken with the decision of the Supreme Court, which is a continuation of an extensive jurisdiction approach declaring the well-being of the family as the main object of protection declared in art. 207 § 1 k.k. (Polish Criminal Code). The problem of proper identification of legal interest protected by art. 207 § 1 k.k. is of fundamental importance for a number of issues raised in the commented decision. The authors indicate the legal interests under art. 207 § 1 k.k., given the current judicature, in particular the object of protection to which Supreme Court refers to in commented decision. The question whether the notion of „family” and „immediate family member” can be seen as identical was considered. Furthermore in the commentary the issues concerning the role played by the title of the chapter of the Criminal Code for indicating the legal interested protected by the provisions has been raised.
