Basarabian Contribution to Legislative Unification and Development of Romanian Interbelic Juridical Science

Summary/Abstract: Reunited to the Kingdom of Romania by decision of the National Council of March 27th/April 9th, 1918, Bessarabia (today the Republic of Moldova) has not only been the first of the three provinces (along with Bucovina and Transylvania) that joined the Romanian state 100 years ago, but also the first where the judicial organization and the statutes of the legal professions were extended, completed by the legislative unification. By the legal and political acts of the union, the 1866 Romanian Constitution and other public law rulings have been extended upon Moldova, between the Prut and Dniester rivers, and a Romanian administration was introduced. Eventually, by a series of royal decrees, justice was reorganized, by introducing the Romanian language, the Body of Lawyers and the institution of the Notary Public. At the same time, were extended: the Criminal and Criminal proceedings codes, Commercial code, the laws regarding the creation of legal persons, factory marks, chambers of commerce and industry, street trade, stock exchange markets, and a part of the Civil Code (1919). The extension of the whole civil legislation was to follow, by the law of April 4th, 1928. Representatives of Bessarabia have taken part at the works of the Central Commission of Legislative Unification (Bucharest), where they have made propositions regarding taking into consideration the Bessarabian specificities – juridical, social, and economic – in the reintegration process of the province to the Old Kingdom. In the development of the interwar Bessarabian legal doctrine, a great part has been played by the legal magazines Cuvântul Dreptăţii (“The Word Of Justice”, 1919-1931) and Justiţia Basarabiei (“The Justice of Bessarabia”, 1935-1938), and also the Circle for legal studies. Amongst the personalities of the age, it is mostly distinguished Vespasian Erbiceanu (1863-1943), first prime-president of the Chişinău Court of Appeal (1918-1923), eventually promoted as councilman of the Court of Cassation, and elected corresponding member of the Romanian Academy in 1931.
