Exclusion of the criminal liability of a pregnant woman for abortion. Selected issues

Summary/Abstract: Tekst porusza kwestię wyłączenia odpowiedzialności karnej kobiety ciężarnej za udział w procederze aborcji na gruncie obecnie obowiązującego stanu prawnego. Oprócz uzasadnienia braku odpowiedzialności matki za samodzielne przerwanie ciąży, analiza dotyczy ewentualnej możliwości pociągnięcia jej do odpowiedzialności za podżeganie lub pomocnictwo do przerwania jej ciąży przez inną osobę. Na tym tyle zaprezentowany został postulat uregulowania klauzuli wyłączającej odpowiedzialność w sposób odmienny niż na gruncie art. 157a § 3 k.k. Odrębnym zagadnieniem podniesionym w tekście jest kwestia oceny udziału ojca dziecka poczętego w przerwaniu ciąży. This paper focuses on the issue of the exclusion of criminal liability of a pregnant woman for the participation in the abortion on the basis of provisions being in force. In addition to the justification of the lack of liability of a mother for self-abortion, analysis concerns the possibility of punishing her for the incitement or the assistance to terminate her pregnancy by another person. In connection with this matter the de lege ferenda proposal to regulate the provision about excluding liability but in a different way than in art. 157a § 3 k.k. (Polish Criminal Code) was introduced. A separate issue raised in the text is the matter of liability of a father of a child conceived for the participation in the abortion.
