Summary/Abstract: Opracowanie zawiera krytyczną analizę rozwiązań dotyczących kary łącznej, wprowadzonych do polskiego systemu prawa na mocy nowelizacji z dn. 20 lutego 2015 r. W szczególności odnosi się do teoretycznych podstaw oraz funkcji i celów instytucji kary łącznej w świetle znowelizowanych przepisów, przy uwzględnieniu modelu kary łącznej stanowiącego podstawę regulacji zawartych w k.k. z 1932 r. oraz k.k. z 1969 r. Praca zawiera analizę podstaw wymiaru kary łącznej, w tym zwłaszcza wskazanie, że także na gruncie znowelizowanych przepisów stanowi ona konsekwencję realnego, wieloczynowego zbiegu przestępstw. W opracowaniu analizie poddano także relacje instytucji kary łącznej do innych mechanizmów redukcyjnych. W tekście przedstawiono rozważania dotyczące charakteru kary łącznej jako instytucji mieszanej, związanej zarówno z płaszczyzną wymiaru kary jak i z płaszczyzną wykonania, a także uwagi dotyczące znaczenia wprowadzenia do polskiego systemu prawa regulacji odnoszącej się do dyrektyw wymiaru kary łącznej. W pewnym zakresie praca zawiera analizę negatywnych przesłanek wymiaru kary łącznej. The article includes a critical analysis of proposals concerning the institution of aggravate penalty which were introduced into Polish legal system by the amendment of Criminal Code from February 20th 2015. In particular, the article refers to the theoretical basis, functions and goals of the institution of aggravate penalty in context of the amended provisions, taking into account the underlying model of aggravated penalty in the regulations contained in the Criminal Code of 1932 and Criminal Code of 1969. The paper contains an analysis of the grounds of imposition of aggravated penalty, in particular an indication that even under the amended provisions the aggravated penalty is a consequence of the real concurrence of crimes. The study also analyzes the relations between the institution of aggravated penalty and other mechanisms of reduction. The text presents considerations about the nature of the aggravated penalty, viewed as a mixed institution connected with both: the imposition and execution of penalties, as well as comments on the importance of introducing into the Polish legal system regulations relating to the directives of imposition of aggravated penalty. To some extent, the paper presents an analysis of the negative premises of imposition of aggravated penalty.
