Summary/Abstract: Considerations included in the article relates to the new institution of substantive criminal law contained in art. 59a of Criminal Code, known as „compensatory discontinuation”, introduced into Polish law system by the Act from September 27th 2013 (Dz. U. 2013, item 1247, as amended) as amended by the Act from February 20th 2015 (Dz. U. 2015, item 396). The article is a summary of the major problems with interpretation emerging on the basis of the solution provided in above-mentioned provision.
