Summary/Abstract: These law, called the "first generation" corresponding "most fundamental laws and freedoms", listed as "laws-resistance" involving freedom of choice and action of individuals, and an abstention from the state. Contrary to economic and social laws, called "human rights in the second generation," it is not right to obtain a benefit, the "laws-claim", but genuine freedom. The border between these rights is no doubt the thin, some may appear as a logical consequence of the other, but in any case, this approach is relevant to the current reality of European human rights law. But, all these laws could not be achieved without the support of police, a very important pawn table law enforcement. The role of police in a democratic society is vital if you want to continue asserting the rule of law, and seeks protection human laws and guaranteeing them the exercise by all citizens. There is a contradiction in the statement that police protection is a fundamental element human rights in a democratic society (because it protects our institution life, home, etc.) It is essential that police, prison staff as to act and be seen as active agents in the human rights.
