Summary/Abstract: Family order and family constitution are new institutions in the Polish practice of regulating succession plans and managing business and family property. Cases of their implementation remain so few, but more and more repeats that without codifying the rules of family order in the family constitution, it is difficult to count on successful succession and correct arrangement of property relations in the family in the longer perspective of the time. The family constitution should in principle codify the culture of management, communication,and decision-making processes in the business family; it can also create foundations to the forming and crystallizing of that culture, going beyond formal regulation in its being. These are new issues also for legal practice. And while we deal with regulations combining business management, property, communication, or family relationships; without a specialist in the lawyer’s succession process will not be appreciated.
