LEGAL REGULATION OF THE RIGHT OF HOUSING IN THE POSITIVE LAW OF THE REPUBLIC OF SERBIA

Summary/Abstract: The right of housing is a special type of personal serviceability and exists only on over things which belong to others, while in legal literature, the right of housing is defined as personal serviceability with the power to use it in building of other or part of a residential building, preserving the essence of things as a whole.Therefore, the right of housing is a legal matter on over things which belong to others, on the basis of which its title holder has the right to use home of another for a dwelling or apartment as a special part of it to the extent necessary for him and the needs of his family members and as a rule includes members of his family, and other faces he cares about. This type of serviceability has only an apartment building or part of it for the building, and this makes it distinct from other personal services.Therefore, the author of this paper will present the legal regulation of the right of housing as a personal service in the Republic of Serbia, which are the rights and obligations of the title of a person and habitant, and above all the right of housing as the basic right of man.
