Summary/Abstract: After an analysis of the concept of contractual liability, the article discusses the contractual or delictual nature of the responsibility of those obliged to supervise minors or incapable persons. He continues with an analysis, from this point of view, of the responsibility of the craftsmen, the hospitals, the psychiatric clinics, the sports clubs to which incapacitated persons have been entrusted.
