Some issues relating to the legislation in the land registry book of arbitral awards delivered in the real estate field

Summary/Abstract: Under the current Civil Code, the transfer or establishment of real rights over immovable property can only be achieved through the entry in the land register book either of an authentic deed concluded in respect of the relevant rights, or a final judgment or an instrument emanating from an administrative body. It is what is called „the constitutive effect of registration in the land registry book”, known in Romanian law under the Decree-Law No. 115/1938 (Articles 17-18).
