Summary/Abstract: The entry into force on 1 January 2016 of the new Law on Restructuring Law also gave many opportunities for entrepreneurs to take advantage of the help to keep the company on the market as well as other entities the opportunity to assess the degree of satisfaction of their claims. Under this procedure, it is necessary to determine whether the aid granted does not constitute unlawful state aid disrupting the free market rule. The answer to this is to run a private creditor test, a private investor test.
