Critical approaches on a timeworn administrative-oriented view over the legal status of civil servants’ employment relations

Summary/Abstract: In the study under the above-mentioned title, the author – taking his stand upon views judged in his opinion as wrong, reported in an article published in the “Romanian Review of Private Law” issue no. 5 / 2010 - resumes and constantly develops his view, published in a study in 2000 and resumed in another in 2010, in that the employment relation of civil servants, as set forth in the Statute of Civil Servants - Law no. 188/1999 – stands for a legal relationship of employment (rather than administrative law-related), obviously distinct from the legal relationship of employment applicable to employees, covered by the Labour Code; hence eadem, sed aliter.
