The possibility to exclude witness statements in case of the incidence of art. 118 of the Code of Criminal Procedure

Summary/Abstract: The author discusses possible means for safeguarding the right granted by art. 118 of the Criminal Procedure Code, after hearing a witness that subsequently became a suspect or defendant, using as a starting point a ruling of the High Court of Cassation and Justice through which the request for a preliminary ruling to settle the legal issue was denied as inadmissible.
