Summary/Abstract: Departing from the solution provided under the previous Criminal Code, Article 104 paragraph (2) of the current Criminal Code stipulates that the commission of a new offense by a person conditionally released from serving a custodial sentence—if the act is discovered during the supervision period and results in a conviction to imprisonment—shall mandatorily lead to the revocation of the conditional release and the merging of sentences under the common law applicable to multiple concurrent offenses.
