Summary/Abstract: The theme of the paper is to juridical institute the civil law, a right of retention. Legal regulation a right of retention belongs to the General civil code – The act, which came into force two hundred years ago. The content of the legal concept be changed. These changes were caused in connection with the development of the legal theory (for a long time was a right of retention from the code completely removed). The paper in addition to comparison of legal regulation in force in our country reflects the content of the draft text of the relevant provisi¬ons of the new Civil Code.
