Summary/Abstract: The non-state actors have a history of existence (the Red Cross movement, religious and charity organizations, foundations, terrorist groups, etc.) but their role has a completely different meaning and importance in the era of globalization, after the fall of the “Iron curtain”. Probably, an open dilemma will remain if the non-state actors are the products or the trigger of globalization; however, a more important question would be their legal status, given that the world as we know and the system of collective security that arise after the World War II was not meant to deal with non-state actors or individuals but with states. Since 9/11, the violent non-state actors have received an even more important role within national and international security. Currently, the UN as a system of collective defense faces the legal dilemma how to approach the ISIL or DAES forces, considering that what happens in the Middle East is certainly a threat to the global peace and security. The ongoing situation in Syria opened the “Pandora’s Box” over the questions of sovereignty, statehoods, the responsibility to protect, as well as the permissibility of the use of force against non-state actors, their subjectivity and ius standi in iudico under the international law.
