Summary/Abstract: The problem of restrictions of the right of property of historical monuments is an excellent example illustrating the tension between freedom of use of property and the public interest expressed by the need to monument’s protect. The historical monuments are one of the key elements of the cultural heritage of the state. The protection of the cultural heritage is a part of the raison d’état, including the need to care for the memory on the cultural identity of the nation. This article aims to discuss the fundamental problems associated with balancing the conflicting values: the protection of right of property and securing the sustainability of the cultural heritage of the state and of humanity. The issue of limiting the right of property of historical monuments are analyzed from the perspective of basic standards for the protection of property contained in the polish Constitution and in the European Convention on Human Rights. Considerations include the concept of property right restrictions, admissibility criteria of restrictions (with particular regard to the principle of proportionality), problem of the compensation for limiting the right of property of historical monuments.
