Summary/Abstract: Whether the international law is to be conceived as (abstract) order of all sovereign states or as (concrete) order of some empires – this is the question to be followed along the criticism which the Romanian scholar Mircea Djuvara adress to Carl Schmitt’s theory concerning the order of the so called greater spaces. The answer will not tend to support any of both positions, but nevertheless both positions will be shown as partially right, more precisely: as right insofar they point out the necessity to overcome the abstractness in legal theory by means of an authentically political legal science.
