Summary/Abstract: The article is devoted to the relationship between the principle of two instances and the principle of the challenge ability of decisions issued at first instance in administrative proceedings considered on the background of the case-law of the Constitutional Tribunal concerning art. 78 of the Constitution. The Author points out differences between the two principles and presents the Constitutional Tribunal’s judgements regarding the limits of admissible derogation in administrative proceedings from the constitutional principle of challenging decisions issued at first instance.
