THE RECOVERY OF FORMALLY ILLEGAL STATE AIDE

Summary/Abstract: Recovery is, in fact, the most important stage in state aid proceedings because only the recovery of illegal aid can (in part) eliminate distortion of competition. Moreover, the recovery decision directly affects the interests of various persons. What are the main principles in state aid proceedings? What amount of aid is to be recovered? In general, what is recoverable under EC law? Is there any chance to avoid recovery of illegal aid? These questions we will tray to answer in this article.
