Summary/Abstract: In many jurisdictions, corporate arbitration is believed to be the most effective tool in terms of solving corporate disputes- especially in cases of questioning of corporate bodies’ resolutions. Under Polish law, as a result of unfavourable introduction of art 1157 and 1163 of the Code of Civil Procedure the objective arbitrability of those disputes remains highly questionable and disputable. To overcome those challenges and definitively grant jurisdiction over corporate disputes to the arbitration courts, the legal doctrine proposes certain solutions. The most significant de lege lata remark is to interpret art. 1163, as a lex specialis over the art. 1157 of the Code of Civil Procedure. On the other hand, the most important de lege ferenda remarks are the A. Szumański’s project as well as M. Tomaszewski’s proposal.
