Summary/Abstract: On a background of an economic crisis, EU Member States have adopted the Stability, Coordination and Governance Treaty. The adoption of this treaty comes as a natural evolution of the rules in budgetary matters, but it is noted by introducing an obligation to respect the budget balance rule. The treaty innovates at the legal level in that it imposes this obligation and, above all, a constitutional preference, which gives rise to numerous debates on the legitimacy and pertinence of introducing the rule of budgetary balance into the constitutional law.
