Summary/Abstract: The aim of the article is an analysis of procedures to protect the rule of law in the European Union, which is applied to the Member States. First of all, it should be emphasized that, although the procedure is legal, it is in fact the application is based on purely political grounds. In the article are analysed the actions taken by the European Commission in relation to the changes made in constitutional system of Poland and Hungary.
