Summary/Abstract: The approaches included in the present study are meant to overview the main rules governing the applications for insolvency settlement. These are analyzed in accordance with the principles and basic rules of the new Code of civil procedure. In the first part of the study there are presented some rules on the insolvency procedure parts and on goods that can not be pursued in this procedure. At the same time, a particular place is occupied by the rules that are applicable to all forms of insolvency procedure or insolvency procedure based on debt repayment plan, the judicial insolvency procedure by liquidation of assets and simplified insolvency procedure. In this context, the author determines the legal nature of the insolvency procedures already mentioned, taking into account the relevant provisions in the matter, the competence of solving and the specific features of the activity carried out by the insolvency committee and by the court.
