Summary/Abstract: In the modern society public policies and the juridical instruments for their implementation must make the object of a continuous evaluation, in order to ensure the standards of good governance. The European membership of our country has also consequences on the mutual influences between the European law and the national law. The functioning of the State – as a regulation field for the Administrative Law – finds itself in a continuous dynamic and evolution, which law must be on a par with. In order to systemize and to consolidate the law in the field of public administration, on the basis of common principles, the regulations can be assembled in a unitary structure, as codes. The Draft of the Administrative Code must ensure coherent legislative solutions that allow the establishment of the social relations from the administrative area.
