The author shows the difficulties of qualifying certain types of online games, such as DFS or eSports, from the perspective of the applicable gambling legislation. The article covers the main legal theories developed by USA courts of law in different jurisdictions in view of identifying a game of change based on the effective level of hazard that influences the result of the activity.
