Summary/Abstract: The article presents a short analysis of the gaming legislation in force in Romania as well as its current shortcomings. The author shows the difficulties of qualifying certain types of online games, such as DFS or eSports, from the perspective of the applicable gambling legislation. The article covers the main legal theories developed by USA courts of law in different jurisdictions in view of identifying a game of change based on the effective level of hazard that influences the result of the activity. The author underlines the necessity of further amending the Romanian gambling legislation in view of separating games of change from skill games that imply a low level of hazard.
