Summary/Abstract: The article is devoted to the analysis of interdependencies of the maritime legislation of the European Union and the International Maritime Organization (IMO). It is also an attempt to answer the question whether this cooperation should be formalized. The European Union, although not a member of the International Maritime Organization, takes an active part in the work of the IMO. For many years, the Union was not interested in the formalization of the cooperation with IMO, relying in this regard on the membership of the Member States. The changes introduced by the Treaty of Lisbon, which provided EU with an international legal subjectivity, allow the EU accession to that organization. However, the Convention on the International Maritime Organization in its current contents makes the Union’s accession to the IMO impossible. Eventual membership would require a change of the Convention provisions. The Author has also doubts if the full member ship of the European Union in the IMO would strengthen its position before the Member States and allow to centralize maritime policy within the EU. In the light of reducing the competence of the Member States in the field of maritime policy and increasing the European Commission’s activity in the IMO, this process seems to take place now.
