Summary/Abstract: In the current legal order the spatial shaping for the purpose of maritime economy takes place in two different legal regimes. The areas of seaports and harbors are governed by the provisions of the Act of 27 March 2003 on spatial planning and development, while the spatial planning and development of marine areas are regulated by the Act of 21 March 1991 on the sea areas of the Polish Republic and the maritime administration. This has caused a lot of problems mainly related to marine spatial planning, which arise, among others, from extremely modest regulation. The actions initiating the process of drawing up a plan of maritime spatial development, which was undertaken at the end of 2013, justify more intensified research concerning the legal aspects of maritime spatial planning.
