Some Issues and Theories Concerning the Institution of the Patrimony

Summary/Abstract: The reconsideration and revision of the issues of patrimony institution as well as that of the patrimonial rights were required by the entry into force of the 2011 Civil Code. As the new Romanian Civil Code regulations are in a close continuity relationship with the Civil Code of 1864, Book III of the new Romanian Civil Code, where the two institutions are based, did not radically alter the conceptual organization of the matter of main real rights.Since the rules contained in the current Civil Code concerning patrimony – also applicable prior to the entry into force of this law – are the result of jurisprudence and doctrine, this article examines the novelty elements brought by the new Romanian Civil Code in force at present.
