Selected Issues Concerning the Conclusion of a Distance Contractin the Light of the Act on Consumer Rights

Summary/Abstract: The Author presents and analyzes the provisions of the Act of 30 May 2014 on consumer rights concerning the conclusion of distance contracts. The indicated normative act implements, inter alia, the Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights into Polish law. The article discusses the amendments introduced by the Act in relation to the solutions provided by the previous Act of 2 March 2000 on the protection of certain consumer rights and on the liability for damage caused by a dangerous product, as well as their impact on the conclusion of distance contracts. The considerations are focused, inter alia, on the meaning of the term “contract concluded at a distance”, the scope and manner of exercising the pre-contractual information duties by entrepreneurs and their contractual obligations, as well as new legal arrangements for the protection of consumers’ economic interests.
