Summary/Abstract: This article determines whether there is justification for special treatment of a public entity on thebasis of the pre-emptive regulation in Polish Civil Code. The author discusses the legal nature ofthis institution, and confirms its civil construction when the state treasury, local government unit,or a state organizational unit is authorized. The author focuses on the provisions of art. 599 § 2,art. 600 § 2, and art. 601 of the Polish Civil Code.
