INDISSOLUBLE LINK BETWEEN THE PROFESSIONAL REPUTATION OF A MAGISTRATE AND HIS PROFESSIONAL DEGREE

Summary/Abstract: Article tackles two aspects which are apparently different, but in reality they are very closely related, namely the professional reputation of a magistrate in relation to his/her professional degree, on the one hand, and legal side slipping of the Romanian judicial system, which allows a prosecutor magistrate to function in units above his professional degree. This article looks and analyses both the position of the Superior Council of Magistracy and the jurisprudence of the Supreme Court in this matter, and also the vulnerabilities that this side slipping generates not only for the human resources policy of the prosecutor units, but also to the lawfulness of acts issued by those in the mentioned situations. This article is in favour of removing legal standards and customs which allows such sideslipping.
