THE PROCEDURE OF COURT FEES - A ILLEGAL ESTABLISHED PRACTICE?

Summary/Abstract: These brief considerations represents the result of practical findings in relation to the calculation of court fees and highlight, the first time, noticeable discrepancies between legal text on taxation of the disputes settled by judges, on the one hand, and practice of the same judges in the matter under review. Specifically, the article analyzes the established practice, under which taxation is calculated by one member of the panel of judges and not by all members, as required by the legal norm. The Article highlights the pressing need for legislative intervention not only to avoid this practice but also to ensure efficient proceedings regarding taxation during the phase before actual trial.
