Summary/Abstract: Polish private law provides sanctions for non-fulfillment of the duties by the members of the management board, supervisory board, liquidators. Market of the public funds function without the concept of the market but the system provides the responsibility of certain subjects (see the Act on violation of public finance discipli- ne) that is quite strongly associated with the criminal law sanctions. Systematics of torts in the field of public procurement is very broad and diverse. Includes, among others, the short comings in fulfilling disclosure requirements. However, penalties in this cases are much less onerous in comparison to the regulated market. The article is comparative in nature and emphasizes the differences in the approach of the legislator to violations of the law.
