Summary/Abstract: The analysis reveals commentary on inconveniences caused by the current regulation, on art. 1.088 of the Civil Code of Romania, on the method for determining the forced heirship and on the surviving spouse’s heirship, considering the doctrine developed by important names in the field of law (M.D. Bob, Fr. Deak, R. Popescu, I. Popa, D. Dunca, D. Negrilă, D. Chirică, M. Eliescu, I. Micescu). Concluding, the author presents his opinion on the surviving spouse’s heirship.
