Summary/Abstract: This article is an attempt to capture the relationship between the opportunistic practices and copyright, in relation to the operation of the BitTorrent P2P file-sharing networks. Article deals with the problem of so-called “copyright trolling”, which consists in achieving the benefits of the presumption of copyright infringement. Here is stand the hypothesis proclaims that “copyright trolling” is a consequence of opportunistic behavior resulting from not adjusted formal institutions of copyright to the existing technological order. In the course of the discussion author deals with the analysis of case studies practices of this kind in Poland. Efforts were made to demonstrate that the practice of the fight against copyright infringementis essentially an attempt to obtain benefits, not to eliminate the phenomena detrimental to the interests of copyright holders.
