Summary/Abstract: The author of this material presents important aspects of the crime of simple smuggling (assimilated variant) required by art. 270 of the. 3 of Law no. 86/2006. During article refers to inconsistent judicial practice of prosecution in such situations and are used by final decisions of the Court of Appeal Timisoara. It makes speech about Decision No. 17/2013 of the High Court of Cassation and Justice and the view of the author on the special quality of the active subject of the crime under debate, namely the authorized contractor to hold a tax warehouse are described in concise definitions of law in this context. Also, the material is presented views expressed by the Criminal justice service of the Prosecutor's Office attached to High Court of Cassation and Justice by note no. 6444/1720/III-13/2014 dated 05.19.2014 and concluded in accordance with the aforementioned note. Finally bringing into question the fact that Romania's general prosecutor has notified the Supreme Court to unravel the question of law on the notion of contraband.
