Aspects regarding the criminal investigation in light of the new procedural provisions

Summary/Abstract: In the present paper the author presents issues waiving prosecution in light of the provisions of Section 3 of art. 318 of the new Code of Criminal Procedure. It analyzes all the ways in which the prosecutor may have besides waiving prosecution charged the suspect or defendant establishment of subsidiary obligations. The author refers to this material and the situation reopening prosecution cases both the prosecutor and the superior prosecutor, under art. 335 of the new Code of Criminal Procedure.
