Summary/Abstract: The fact that the term of 10 days from the gun license expiry date has been exceeded is not sufficient to establish that the crime provided by Article 140 of the Law No. 295/2004 regulating the management of weapons and ammunitions, republished, has been committed. The crime is committed upon the expiry of 10 days from the receipt, by the holder of the gun permit whose validity has expired, of the notification from the police about the cancellation of his/her gun license, followed by that person’s failure to turn over his/her gun to the adequate authority.
