Summary/Abstract: The article discusses the issues concerning the applicability of Article 37a Criminal Code, providingthe possibility of commutation of the sentence of imprisonment for a penalty to be libertarian,which came into force on 1 July 2015, in case of committing a transgression of a hooligan. A newArticle 37a Criminal Code, and in particular the issues concerning the nature of that provision asa standard of “beforebracket” influencing the threat of statutory regulations of the framework. Theconclusion was that by eliminating Article 58 § 4 Criminal Code and the introduction of Article37a Criminal Code it is possible to use fines and penalties of restriction of liberty for perpetratorsof crimes of a hooligan.
