Summary/Abstract: Settlement by the Department of criminal and juvenile cases of the Court of Appeal of Craiova of a case having as object the appeals made by some of the defendants, against the judgment passed to the appeals of prosecution, defendants and civil parties – through which the first court’s judgment was quashed and the case was sent back to the First Instance Court for rejudgment, among others, highlights the need for a closer look on effects of the appeal, as a second ordinary appeal, in criminal proceedings. The same case also raised the matter of the prosecution right to appeal against a decision on a criminal matter, under civil law, when the civil party does not formulate an appeal.
