Summary/Abstract: As such, by rigorously and logically interpreting the text of Article 42 of Law no. 407/2006, the only conclusion we must reach is that the poaching offence (as referred to herein), if committed according to one of the afore-mentioned patterns, also exists when the incriminated actions do not result in the capture or killing of the prey.
