Summary/Abstract: Ratifying the 14th Protocol to the European Convention on Human Rights, starting with 01.06.2010, the European Union became practically the 48th state of the European Council and the competence of the European Court on Human Rights extended also on the European Union. Having as result a number of theoretical and practical problems, that the author approaches within this study.
