Communication of prosecutor solution. Personal data protection

Summary/Abstract: As a practical solution, we think that in case the text of the resolution or ordinance of the prosecutor contains such data and the person to which said resolution is notified doesn’t show a legitimate interest to find them, it is understood that those data will be excluded from the copy transmitted, while a relevant excerpt of the resolution will be notified as ground of the solution. However, it is possible that the personal data or part of them may already be known to the consignee, (for example, when there exist family relationship or from the file, if the parties were previously engaged in another case), but, in our opinion, the principle to be considered is that of an restrictive interpretation of the legal provisions applied, for preventing possible prejudices to the person whose personal data are revealed.
